Terms of Service

1. Acceptance of Terms

By creating an account or using Symptune in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years of age to use Symptune. By using the service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into this agreement.

3. Your Account

You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Providing accurate and complete information
• Notifying us promptly of any unauthorized access to your account

You may not share your account with others or use another person's account. We are not liable for losses caused by unauthorized use of your account.

4. Subscription and Billing

Some features of Symptune require a paid subscription. Subscriptions are billed in advance on a monthly or annual basis and renew automatically at the end of each billing period until cancelled.

You may cancel your subscription at any time through your account Settings. Cancellation takes effect at the end of the current paid billing period. We do not offer prorated refunds for unused time within an active billing period.

Payment processing is handled by Stripe, Inc. By subscribing, you also agree to Stripe's terms of service. We do not store your payment credentials.

We reserve the right to change subscription pricing with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

• Use Symptune for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse-engineer, decompile, or exploit any part of the platform
• Interfere with or disrupt the platform or the servers and networks connected to it
• Scrape, copy, or redistribute any content from the platform without written permission
• Misrepresent your identity or impersonate any person or entity
• Use the platform in any way that could damage, disable, or impair it

6. Your Data

Your personal tracking data belongs to you. You can export it at any time from your account Settings. We will not sell or share your health-adjacent behavioral data with third parties except as described in our Privacy Policy.

By entering data into Symptune, you grant JADCO LLC a limited license to store and process that data solely to provide and improve the service. This license terminates when you delete your account and your data is purged.

7. Intellectual Property

All content, design, software, trademarks, and trade names comprising the Symptune platform are owned by or licensed to JADCO LLC. Nothing in these Terms grants you any right to use our intellectual property without explicit written permission.

You may not reproduce, distribute, modify, or create derivative works from any part of the platform without our prior written consent.

8. Disclaimer of Warranties

SYMPTUNE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the service.

Pattern insights shown in Symptune are based solely on data you enter and are intended as organizational tools, not medical findings. We make no representations about the clinical validity of any correlation or pattern displayed.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JADCO LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF SYMPTUNE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF SYMPTUNE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

10. Indemnification

You agree to indemnify, defend, and hold harmless JADCO LLC and its members, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of Symptune, your violation of these Terms, or your violation of any applicable law or third-party right.

11. Termination

We reserve the right to suspend or terminate your account at our discretion for violation of these Terms, harmful conduct, or any other reason with or without notice. Upon termination, your right to access the service ceases immediately.

You may terminate your account at any time by deleting it in Settings. Termination does not entitle you to a refund for any unused portion of a paid subscription.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from or related to these Terms or your use of Symptune shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by a prominent notice on the site at least 14 days before the changes take effect. Your continued use of Symptune after the effective date of any update constitutes your acceptance of the revised Terms.
